Public offer and Terms of Use

  • PUBLIC OFFER FOR THE PROVISION OF HOTEL SERVICES

    This document constitutes an official offer (public offer) of Alpine Hotel LLP to conclude a hotel services agreement with any individual under the terms set forth below, in accordance with the Civil Code of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan.

    Full and unconditional acceptance of this Offer shall be deemed to occur when the Guest performs a conclusive action — clicking the “Book” button on the official Hotel website and/or paying for the reservation.

  • 1. DEFINITIONS AND INTERPRETATION

    1.1. Definitions

    The following terms shall have the meanings set forth below unless the context requires otherwise:

    “Hotel” — Alpine Hotel LLP.
    “Guest” — an individual accepting the terms of this Offer and receiving hotel services.
    “Parties” — the Hotel and the Guest collectively.
    “Party” — the Hotel or the Guest individually.
    “Day” — a calendar day unless otherwise expressly stated.
    “Business Day” — a working day under the laws of the Republic of Kazakhstan.
    “Card” — a plastic magnetic-stripe card identifying the Guest as a hotel resident.
    “Agreement” — this hotel services agreement concluded between the Hotel and the Guest, including all amendments and appendices.
    “Legislation of the Republic of Kazakhstan” — the body of regulatory legal acts duly adopted in the Republic of Kazakhstan.
    “Third Parties” — any individuals or legal entities other than the Parties.
    “Website” — the Hotel website located at: http://tenirhotels.com.
    “Booking and Payment Rules” — procedures for reservation, cancellation, payment, and refunds.
    “Rates” — the document containing prices for hotel services.
    “House Rules” — rules governing Guest conduct during their stay at Tenir Eco Hotel.
    “Privacy Policy” — rules governing processing and use of the Guest’s personal information, including personal data.

  • 2. SUBJECT OF THE AGREEMENT

    2.1. The subject of this Agreement is the provision by the Hotel of hotel services to the Guest under the terms set forth herein. The full list of services is available on the Website.

    2.2. Hotel services are provided at Tenir Eco Hotel, located at:
    Shymbulak Mountain Resort, Medeu District, Almaty, Republic of Kazakhstan.

  • 3. RIGHTS AND OBLIGATIONS OF THE HOTEL

    3.1. The Hotel shall:

    3.1.1. Provide the Guest with necessary information about hotel services via the Website and/or this Agreement.
    3.1.2. Provide hotel services properly and in good faith.
    3.1.3. Comply with consumer protection and personal data legislation of the Republic of Kazakhstan.

    3.2. The Hotel has the right to:

    3.2.1. Require the Guest to comply with this Offer and the House Rules.
    3.2.2. Require full payment for hotel services.
    3.2.3. Refuse accommodation if the Offer or applicable law is violated.
    3.2.4. Unilaterally terminate the Agreement in case of a material breach by the Guest.

  • 4. RIGHTS AND OBLIGATIONS OF THE GUEST

    4.1. The Guest shall:

    4.1.1. Independently review the list of hotel services on the Website.
    4.1.2. Provide accurate personal information about themselves and accompanying persons.
    4.1.3. Timely and properly pay for hotel services.
    4.1.4. Comply with House Rules, sanitary, and fire-safety requirements.
    4.1.5. Compensate for damage caused to the Hotel or third parties.
    4.1.6. Pay for services in accordance with this Agreement.

    4.2. The Guest has the right to:

    4.2.1. Demand proper fulfillment of the Hotel’s obligations.
    4.2.2. Receive information about services and prices.

  • 5. PAYMENT FOR HOTEL SERVICES

    5.1. The cost of services is determined by the Rates effective on the booking date.
    5.2. Cancellation, refund, and booking guarantee terms are governed by the Booking and Payment Rules.
    5.3. Bank fees are borne by the Party incurring them.

  • 6. TERM OF THE AGREEMENT

    6.1. The Agreement is deemed concluded upon acceptance of the Offer.
    6.2. The Agreement remains valid until full performance by the Parties or early termination in accordance with the legislation of the Republic of Kazakhstan and/or this Agreement.

  • 7. LIABILITY OF THE PARTIES

    7.1. The Parties are liable in accordance with the legislation of the Republic of Kazakhstan and this Agreement.
    7.2. Payment of penalties or damages does not release the Parties from performance of obligations.
    7.3. The Guest must compensate damage caused to the Hotel or third parties upon the Hotel’s request.
    7.4. Penalties apply from the moment a demand is issued.
    7.5. The Hotel’s liability for real damage due to non-provision of services is limited to the booking amount.
    7.6. The Hotel is not responsible for loss of money, securities, or valuables not deposited for safekeeping.

  • 8. CONFIDENTIALITY

    8.1. Personal data processing is carried out in accordance with Kazakhstan law and the Privacy Policy.
    8.2. Acceptance of this Offer constitutes consent to personal data processing.

  • 9. FORCE MAJEURE

    9.1. The Parties are released from liability for non-performance caused by force majeure.
    9.2. This includes natural disasters, earthquakes, mudflows, fires, avalanches, landslides, power outages, governmental restrictions, and other circumstances beyond the Hotel’s control.
    9.3. The Hotel is not liable for failures caused by inaccurate or late information provided by the Guest.
    9.4. The affected Party must notify the other within 5 calendar days and provide official confirmation.

  • 10. DISPUTE RESOLUTION

    10.1. Disputes shall be resolved through negotiations.
    10.2. If unresolved, disputes shall be submitted to a competent court at the Hotel’s legal address in accordance with Kazakhstan law.

  • 11. MISCELLANEOUS

    11.1. Integral parts of the Agreement:

    • Rates

    • Booking and Payment Rules

    • House Rules

    • Privacy Policy

    11.2. Documents apply in the version effective on their stated date.
    11.3. The Hotel may amend this Offer by publishing a new version on the Website.
    11.4. Amendments apply to bookings made after publication.
    11.5. The Agreement may be terminated by mutual consent or other lawful grounds.
    11.6. Unregulated matters are governed by Kazakhstan law.
    11.7. Notices via email, messengers, or telephone are deemed duly delivered.
    11.8. The Parties must promptly inform each other of circumstances affecting performance.
